The following is a statement from the Texas Nationalist Movement condemning Jeff Session’s claim that there is no nullification or secession.

While in Sacramento yesterday, in support of the Trump administration’s suit with California over their resistance to federal law concerning illegal immigration, U.S. Attorney General Sessions said the following:

“There is no nullification. There is no secession.”

Sessions also added that “Federal law is ‘the supreme law of the land.’ I would invite any doubters to Gettysburg, and to the graves of John C. Calhoun and Abraham Lincoln.”

TNM appreciates the many difficulties associated with illegal immigration. However, in dealing with such issues, all federal actions must be informed by the Constitution of United States: the real “supreme law of the land.” It is unbecoming of a U.S. Attorney General to claim powers not granted him by COTUS, and then appeal to the graves of fallen soldiers to bolster his case. As such, the Texas Nationalist Movement condemns Jeff Sessions’s comments.

It is an elementary part of our tradition of law, going back hundreds of years, that “Everything which is not forbidden is allowed.” Under the Tenth Amendment to the Constitution, secession and nullification, being powers “not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.” If the Trump administration would like to forbid these powers to the States, they would need build support for a constitutional amendment declaring so. Until then, they remain powers exclusive to the states and the people.

The fact that this administration is showing itself increasingly casual about depriving the States of their legal rights is disturbing and only underscores the dire need of the Texas people vote on their own continued association with this political union. If Texas wants to preserve the Liberty and self-governance that we are promised in the U.S. and Texas constitutions, then we must reassert our political, cultural, and economic independence apart from the American union.
